Orleans Parish District Attorney Leon Cannizzaro says his office is deferring to federal authorities and will not file any charges against an FBI agent who fatally shot a man in New Orleans in July.
Cannizzaro told The New Orleans Advocate on Friday that he referred the matter to U.S. Attorney Kenneth Polite Jr.'s office last month after determining federal authorities have jurisdiction over the case. Cannizzaro said his office "did not get into the facts of the case."
The FBI hasn't released the name of the agent who fatally shot Allen Desdunes in a motel parking lot on July 30 during a surveillance operation for a drug investigation.
An FBI spokeswoman says the agent remains on duty.
